Privacy Notice

1. Who we are?

Blue Sky Intermodal (UK) Ltd (hereinafter referred to as the Company, we or us) is an international marine container leasing company providing containers and related equipment on operating and finance leases to the container industry amongst other related industry services.

2. What data do we collect?

Personal data under the EU’s General Data Protection Regulation (GDPR) is defined as:

“any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name,
an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identify of that natural person”.

The data that we will collect will be your name, job title, work address and work contact details such as mobile telephone number and e-mail.

3. How will your data be used?

We will use your data to input into our operational line of business applications which will be used to notify you of operational transactions relating to our business (where relevant). We will also add your details to our e-mail server and contacts databases so that we can send you updates as necessary relating to our business transactions.

If you request access to our web portal, we will create an account for you and your name and e-mail address will be stored for access and security purposes.

If the Company is acquired or involved in a merger, we will continue to ensure the confidentiality of your personal data in accordance with GDPR however it may be transferred or becoming subject to a different privacy policy. Your rights will remain unaffected.

4. Consent and withdrawal

By consenting to this privacy notice by way of entering into business to business relations with the Company, you are granting us permission to process your data specifically for the purposes identified in section 3.

If you wish to withdraw consent this can be done by contacting the (acting) data protection officer at Blue Sky via e-mail (dpo@bsiu.com) and informing them of the data that you wish to remove the consent for. By removing consent, this may restrict your access to some of the services offered by the Company.

Where possible we will remove your records upon your request. If this is not possible, your personal data will be anonymised to protect your identity unless there is a qualifying regulatory reason that does not allow us to do so.

5. Disclosure

We will never sell your data or pass this on for the purposes of marketing or cold calling.

The Company may provide access to your personal data to third parties that we directly work with. These are normally software vendors that are used by the Company to develop the main line of business applications and your data will only be passed to them as part of the database ongoing maintenance and administration.

These companies, sometimes referred to as data processors (including the Company), may change from time to time.

In addition, we may pass your details to any court regulator, government authority, law enforcement agency or other third party where we believe this is necessary to comply with a legal or regulatory obligation.

6. Retention of your data

We will retain your data for the period that we are doing business with you. We will review the data periodically to ensure that it is relevant, and we may contact you in the future to re-confirm your details.

When requested, we will remove your data as soon as is possible. If we are legally required to retain this data, then we will retain this until the expiration of that legal requirement.

7. Your rights

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

  1. Right of access – you have the right to request a copy of the information that we hold about you.
  2. Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
  3. Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
  4. Right to restriction of processing – where certain conditions apply to have a right to restrict the processing.
  5. Right of portability – you have the right to have the data we hold about you transferred to another organisation.
  6. Right to object – you have the right to object to certain types of processing such as direct marketing.
  7. Right to object to automated processing, including profiling – you also have the right to be subject to the legal effects of automated processing or profiling.
  8. Right to judicial review – in the event that the Company refuses your request under rights of access, we will provide you with a reason as to why. You have the right to complain as outlined in section 8 below.

All of the above requests will be forwarded on should there be a third party involved in the processing of your personal data.

This policy may change from time to time. The last amended date of the policy is displayed below. We will never reduce your rights stated within this privacy policy without your consent being explicitly given. If the changes made
to this policy are significant, then we will provide a more prominent advisory to review the amended policy.

8. Complaints

In the event that you wish to make a complaint about how your personal data is being processed by the Company (or third parties as described in 5 above), or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and the Company’s data protection representatives.
